JBI International (hereinafter referred to as the "JBI Library," "we" or "our") values our customers' privacy, which is why we are committed to being transparent about our privacy practices. This Privacy Notice describes the collection, use and disclosure of your information when you visit our website or use our services (hereinafter "Services"). By accessing the Services, and/or providing your information, you agree to the JBI Library Online Privacy Notice (hereafter, "Notice").
1. Personal Data We Collect And Use
We collect Personal Data about you directly from you, automatically from your devices, and from third parties. Where we collect data about you from one of these sources, we have outlined the purposes for its collection and the Personal Data collected for that purpose below.
a. Personal Data You Provide
You may provide us with Personal Data directly through your interactions with us for the following purposes:
- Account Registration: If you register with JBI Library and when you update your profile, we collect personal data that you provide to us, such as name, email address, and phone number, directly from you.
- Communicate with You: To communicate with you about your use of our Services or updates regarding our Services, respond to your inquiries, and provide customer service, we may collect email addresses and phone numbers directly from you.
- Marketing, Advertising and Promotions: To evaluate the effectiveness of our marketing and advertising campaigns, to send you newsletters, offers or other information about products and Services we offer, to contact you about our Services or information we think may be relevant to you, and to administer promotions, we may collect email address, and phone number directly from you.
- To request feedback: We may use your personal data to request feedback and to contact you about your use of our Platform so that we can improve our products and Services and develop additional products and Services to better serve our users. The personal data collected for these purposes include email address, phone number.
- User Generated Content: You may submit content that you create to us for use on our site (such as through our Q&A tool) or in other promotional or marketing communications. We only use content that you create with your consent. The information that you provide may include personal information such as name and circulation details. Please note that all user generated content is subject to moderation, and that by submitting content you consent to JBI Library moderating your content.
- Event Registration: You may provide us with your name, phone number, and email address when you register or purchase tickets for one of our events, and we may take photos at events that include you. We may use this information for tracking registrations and confirming attendance, as well as for creating promotional or marketing materials.
- To post testimonials: We post testimonials on the Platform that may contain personal data, including name, location, and testimonial which you submitted. Prior to posting a testimonial, we will obtain your consent to use your name and testimonial. You have the right to withdraw your consent at any time, without affecting the lawfulness of the processing based on consent prior to such withdrawal.
- When you interact with us on social media: We may collect any correspondence you send or direct to us. We will use this information to administer our social media accounts, and to interact and correspond with you on social media.
- Defending Legal Rights: to manage and respond to actual and potential legal disputes and claims, and to otherwise establish, defend, or protect rights or interests, including in the context of anticipated or actual litigation, we may collect circulation history directly from you.
- Auditing, Reporting, Governance and Internal Operations: to conduct our business, including fulfilling our financial, tax and accounting obligations, such as audits, assessments, privacy, security, and financial controls, accounting, record keeping and legal functions, any actual or contemplated merger, acquisition, asset sale or transfer, financing, bankruptcy, or restructuring of all or part of our business, we may collect circulation history directly from you.
b. Information Collected From Your Devices
We also collect information about how you use our Services from your device(s) or browser, for the following purposes:
- Account Registration: If you register with JBI Library and when you update your profile, we collect personal data that you provide to us, such as name, email address, phone number, and address automatically from your device(s).
- Communicate with You: To communicate with you about your use of our Services or updates regarding our Services, respond to your inquiries, and provide customer service, we may collect software usage and browsing history automatically from your device(s).
- Providing Products and Services: In order to provide our Services, operate our website operate our Integrated Library System software, troubleshoot bugs and provide technical support, we may collect software usage and browsing history automatically from your device(s).
- Targeted Advertising: We may use your personal data to develop and display content and advertising (and work with third parties who do so) tailored to your interests or location and to measure its effectiveness, including: device and usage information, such as your software usage and browsing history, information about how and when you use the Platform and other technical information. We will ask your consent to use your personal data for this purpose. You can opt out of our marketing emails at any time (see the section 9 below). You also have the right to withdraw your consent at any time, without affecting the lawfulness of the processing based on consent prior to such withdrawal.
- Analyzing and Improving our Products and Services: to better understand how our customers and visitors use our Services and websites, to improve our websites, Services, and business operations, to develop new products and Services, to conduct surveys, and for research and analysis purposes, we may collect software usage and browsing history automatically from your device(s).
- Personalizing Content and Experiences: to tailor content we send or display on our websites and Services, to offer location-based customization and personalization, and to otherwise personalize your experiences, we may collect software usage and browsing history automatically from your device(s).
- Protecting our Business: to protect and secure our business, systems, the Services and our websites, to investigate, prevent, detect and respond to fraud, unauthorized access, or other potential threats to the rights and safety of any individual or third party, or other unauthorized activities or misconduct, we may collect software usage and browsing history automatically from your device(s).
- Defending Legal Rights: to manage and respond to actual and potential legal disputes and claims, and to otherwise establish, defend, or protect rights or interests, including in the context of anticipated or actual litigation, we may collect software usage and browsing history automatically from your device(s).
- Auditing, Reporting, Governance and Internal Operations: to conduct our business, including fulfilling our financial, tax and accounting obligations, such as audits, assessments, privacy, security, and financial controls, accounting, record keeping and legal functions, any actual or contemplated merger, acquisition, asset sale or transfer, financing, bankruptcy, or restructuring of all or part of our business, we may software usage and browsing history automatically from your device(s).
- Complying with Legal Obligations: to comply with the law, our legal obligations and legal processes (such as warrants, subpoenas, court orders, and regulatory or law enforcement requests), we may collect software usage and browsing history automatically from your device(s).
c. Personal Data Provided by Others
We may also collect certain Personal Data about you from third parties for the following business purposes:
- Analyzing and Improving our Products and Services: to better understand how our customers and visitors use our Services and websites, to improve our websites, Services and business operations, to develop new products and Services, to conduct surveys, and for research and analysis purposes, we may collect software usage from third parties.

d. Other Purposes For Which We May Use The Personal Data We Collect
We may use any personal data we collect as described above for the following business purposes:
- To develop our Products and Services: We may use your personal data to further develop or improve our existing products and services, including artificial intelligence tools and features, or to develop new products and services.
- To Protect the Platform, Us, and Others: We may use your personal data as part of our efforts to keep the Platform safe and secure (for example, for fraud monitoring and prevention) and to protect others from harm or abuse.
- To Enforce our Terms, Conditions and Policies: We may use your personal data to ensure you and others are complying with our terms, conditions and policies, including providing your information to law enforcement if we believe it is appropriate to do so and using your information in connection with legal proceedings brought by us or against us.
- To Respond to Legal Requests and Comply with Applicable Law: If we receive a subpoena, discovery request, or other legal request, we may need to review and evaluate your personal data and potentially provide your personal data in response to the request. We may also need to use your personal data as needed to comply with applicable laws and regulations.
- For other Business Purposes: We may use your information for other business purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate and improve the Platform, products, services, and your experience.
2. Cookies And Similar Technologies
When you visit our Sites or use our Services, we and our business partners and vendors may use cookies, web beacons (also known as "tracking pixels"), embedded scripts, location-identifying technologies, device fingerprinting, device recognition technologies, in-app tracking methods and other tracking technologies now and hereafter developed ("Tracking Technologies"). Tracking Technologies are used to recognize you as a User and to customize your online experiences, the Services you use, serve you online content and advertising; measure the effectiveness of promotions and perform analytics; and to mitigate risk, prevent potential fraud, and promote trust and safety across our Sites and Services. Certain aspects and features of our Services and Sites are only available through the use of Cookies, so if you choose to disable or decline Cookies, your use of the Sites and Services may be limited or not possible.
a. Tracking Technologies Generally
Regular cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Browsers offer different functionalities and options so you may need to set them separately. Also, tools from commercial browsers may not be effective with regard to Flash cookies (also known as locally shared objects), HTML5 cookies, or other Tracking Technologies. Please be aware that if you disable or remove these technologies, some parts of the websites may not work and that when you revisit the websites your ability to limit browser-based Tracking Technologies is subject to your browser settings and limitations.
b. Analytics and Advertising Tracking Technologies
You may exercise choices regarding the use of cookies from Google Analytics by going to https://tools.google.com/dlpage/gaoptout or downloading the Google Analytics Opt-out Browser Add-on.
c. Disabling, Deleting, or Opting-Out of Cookies
Most web browsers allow at least some control of most cookies through browser settings. You may refuse the use of cookies by selecting the appropriate settings on your browser to decline cookies. You may also delete existing cookies through your browser. Please note, if you disable cookies, you may not be able to use the full functionality of our websites. In particular, you may have limited access to some areas or be transitioned to a different experience.
You may also disable JavaScript at any time. Please remember: some features of our websites may not function properly unless cookies and JavaScript are enabled, and some areas of our websites may not function at all.
You may choose to delete cookies placed on your device and to block new third-party cookies from being placed by using your internet browser's privacy and security settings.
3. De-Identified and Aggregate Data
JBI Library may de-identify and aggregate data for its business purposes, including but not limited to, to improve the products and features of its Services, to maintain the security and integrity of its systems, for analytics, and other legitimate business purposes. Where we process De-identified Data, we commit to maintain and use the information in de-identified form and not attempt to reidentify the information, except where permitted by law. JBI Library may disclose De-identified Data to third parties who commit themselves to maintaining the De-identified Data in de-identified form and not attempt to re-identify the data for any business purpose.
4. How We Share Personal Data
We may share information about you to third parties as indicated below:
- With other companies that provide services to us: We may share Personal Data with third-party service providers that perform services and functions at our direction and on our behalf. These third-party service providers may, for example, provide you with Services, assist in processing transactions, allow us to send you advertisements for our products and Services, provide customer support, send email marketing on our behalf, etc. We do not sell your information to these third-party service providers. We may share your personal data with the following categories of third-party service providers for one or more of the purposes described above and if there is a legal basis:
- Invoice and billing service providers
- Our Integrated Library Service database provider
- In aggregated, de-identified form to provide data to third parties for our benefit: We may provide aggregated statistical data to third-parties for our own analytics and business purposes. This data will not personally identify you or provide information about your specific use of the Sites or Services. We do not share your Personal Data with third parties for their marketing purposes without your consent.
With respect to any donations (whether made on-line, by mail or in person): We may share only financial donor postal mailing address lists with other non-profits for a one-time non-commercial use by the other non-profit. These lists do not contain any other personally identifiable information or any financial information about a donor. If you are a financial donor to JBI International, you may submit an "opt-out" request that we withhold your mailing information from any list exchanges with other non-profits, in one of three ways:

- With the other parties to transactions when you use the Services, such as payment processors and their service providers: We may share information about you and your Account with the other parties involved in processing your transactions. This includes payment processors and their service providers. The information might include:
- Personal Data, payment information and Account information necessary to facilitate and/or authenticate the transaction;
- information to help resolve disputes and detect and prevent fraud; and
- aggregated data and performance analytics to help us and our merchants better understand user behavior and to help us enhance user experiences.
- With other third parties for our business purposes or as permitted or required by law: We may share information about you with other parties for our business purposes or as permitted or required by law, including:
- if we need to do so to comply with a law, legal process or regulations;
- to law enforcement authorities or other government officials, or other third parties pursuant to a subpoena, a court order or other legal process or requirement applicable to Us;
- if we believe, in our sole discretion, that the disclosure of Personal Data is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity;
- to investigate violations of or enforce a user agreement or other legal terms applicable to any Service;
- to protect our property, Services and legal rights;
- in connection with shipping, payment and related services for purchases made using a Service;
- to help assess and manage risk and prevent fraud against us, our Users and fraud involving our Sites or use of our Services, including fraud that occurs at or involves our business partners, strategic ventures, or other individuals and merchants;
- to banking partners/payment processors as required by card association rules;
- to credit reporting and collection agencies;
- to companies that we plan to merge with or be acquired by; and
- to support our audit, compliance, and corporate governance functions.
- With your consent: We also will share your Personal Data and other information with your consent or direction, including if you authorize an account communication with a third-party account or platform.
- Affiliates and Subsidiaries: We may share your Personal Data with our different affiliates and subsidiaries. If we share your information, we will share only the information that is necessary and we will take reasonable steps to make sure that third parties take prudent steps to protect your information.
- Marketing: We may share your Personal Data to deliver marketing communications to you. Absent your consent (which may be by means of opt-in, or a third-party interaction described in the next bullet point), however, JBI Library will not share your Personal Data with third parties, other than Affiliates, for their own direct marketing purposes, except in connection with changes in business structure or ownership (defined below).
- Social Media: Certain pages of our Websites might include social media features, such as the Facebook "Like" button, and widgets, as well as the "Share This" button or interactive mini-programs that run on our Website. These features might require us to implement cookies, plug-ins, or application programming interfaces (APIs) provided by such social media platforms to facilitate the communications and features. When you provide us with information through these platforms, the information also becomes subject to their privacy statements. In addition, by choosing to use any third party social media platform or choosing to share content or communications with any social media platform, you allow us to share information with the designated social media platform. We cannot control any policies or terms of such third party platforms. As a result, we cannot be responsible for any use of your information or content by a third party platform, which you disclose at your own risk. We encourage you to review the privacy statements of these platforms.
- Compliance with Legal Obligations: We may need to disclose certain information to auditors, government authorities, law enforcement, regulatory agencies, our legal counsel, third party litigants and their counsel, or other authorized individuals in order to comply with laws that apply to us, or other legal obligations such as contractual requirements.
- Changes in Business Structure/Ownership: We may disclose or transfer your Personal Data to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of JBI Library's business, assets, or ownership interest (including any bankruptcy or similar proceedings).
We do not sell any individual's Personal Data, nor do we share that Personal Data with third parties for those parties' commercial use.
5. California Rights (Shine the Light Notice)
California residents have the following additional rights regarding disclosure of your Personal Data to third parties for their own direct marketing purposes:
We provide California residents with the option to opt-in to sharing of "Personal Data" as defined by California's "Shine the Light" law with third parties, other than with our affiliates, for such third parties' own direct marketing purposes. We do not share Personal Data with non-Affiliate third parties for their direct marketing purposes absent your consent. If you are a California resident, you may request information about our compliance with the Shine the Light law and/or withdraw previously given consent to sharing with non-Affiliate third parties for their direct marketing purposes by contacting using the methods in the "Contact Us" section below. Requests must include "California Marketing Privacy Rights Request" in the first line of the description and include your name, street address, city, state, and zip code. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through the provided e-mail address or mailing address.
6. Children's Privacy
Our Services are not intended for use by anyone under the age of eighteen (18). In accordance with the Children's Online Privacy Protection Act ("COPPA"), we do not knowingly request or solicit Personal Data from anyone under the age of eighteen (18) nor will we knowingly allow anyone under the age of eighteen (18) to create a user account. In the event that we receive actual knowledge that we have collected such Personal Data without the requisite and verifiable parental consent, we will delete that information from our database as quickly as is practical. We reserve the right to request proof of age at any stage so that we can verify that minors are not using the Services.
7. How We Protect Your Personal Data
We strive to take appropriate security measures to help safeguard your Personal Data from unauthorized access and disclosure. For example, only authorized employees are allowed to access Personal Data, and they may only access it for permitted business functions. We maintain technical, physical, and administrative security measures designed to provide reasonable protection for your Personal Data against loss, misuse, unauthorized access, disclosure, and alteration. The security measures include firewalls, data encryption, access controls to our data centers, and information access authorization controls.
While we are dedicated to securing our systems and Services, we cannot guarantee that loss, misuse, or alteration will never occur, we use reasonable efforts to prevent it. Please keep in mind that no method of storage or transmission over the Internet is completely secure, so your use of our services and provision of information to us is at your own risk.
You are responsible for securing and maintaining the privacy of your password(s) and Account/profile information and verifying that the Personal Data we maintain about you is accurate and current. We are not responsible for protecting any Personal Data that we share with a third-party based on an account communication that you have authorized.
8. Changes To This Notice
We reserve the right to change this Notice prospectively effective upon the posting of the revised Notice and your use of our websites indicates your acknowledgement of the Notice posted at the time of use. However, should we update this Notice, we will post a new version online, and will notify you if the Personal Data processed about you will be materially different than that which was represented to you at the time it was collected. To the extent any provision of this Notice is found by a competent tribunal to be invalid or unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.
